There are always risks when getting behind the wheel, but that danger is multiplied when mounting a motorcycle. Without the protection that seat belts and airbags provide in cars and trucks, even a “fender bender” can lead to serious injuries for motorcyclists. It is an unfortunate truth, but even wearing a helmet, protective clothing and obeying the rules of the road cannot always keep you accident- or injury-free.
Every time a motorcyclist hops onto their bike, whether it is for a leisurely Sunday-morning cruise or commuting to the office, they face many risks that are, oftentimes, out of their control. Inattentive drivers who may swerve into neighboring lanes, roll through stop signs, ignore side and rearview mirrors before switching lanes or make emergency stops are just a handful of the potentially deadly collisions waiting to happen. These risks are amplified by all-too-common negligent behavior, such as driving while intoxicated and texting while driving.
According to a 2014 National Highway Traffic Safety Administration report, just over 4,500 motorcyclists were killed in accidents and an additional 92,000 were injured. Though safety equipment and safe driving can surely reduce a motorcyclists’ risk of injury, there is no such thing as 100% safety when on the road–especially when drivers may not value safe driving as much as you do.
The attorneys at Wieland Hilado & DeLattre are very experienced in handling motorcycle accidents. Over the years, we have represented clients that are avid motorcycle riders and have been doing so for years. Very few of our clients are aware of the specifics of Florida’s helmet law, which states, in part: “A person over 21 years of age may operate or ride upon a motorcycle without wearing a helmet if they are covered by an insurance policy providing for at least $10,000.00 in medical benefits…” For example, the $10,000.00 requirement can be satisfied if you have health insurance or medicare.
If you are involved in an accident while riding your motorcycle, do not hesitate to consult the personal injury professionals at Wieland Hilado & DeLattre to ensure that you receive the treatment and compensation you deserve. Often times, injuries may not manifest immediately after the accident, only making themselves painfully apparent once the shock and adrenaline of the crash wear off. Report your accident to the police, seek immediate medical consultation and, if possible, take photographic evidence at the scene. All of these steps can be used to defend your claim.
Words cannot express the professionalism you and your staff had given us in our time of need. I’m a retired law enforcement officer who was injured in the line of duty. I’m very pleased with the performance, support, professionalism and determination throughout my case.
